Why Daimler received the heaviest sanction
As the largest seller of heavy goods vehicles in Europe, Daimler sat at the centre of the arrangement. Investigators established that its executives met competitors regularly to set gross list prices across the continent.
The group also agreed with the other members to coordinate the timetable for introducing environmental technology and to pass the full cost on to buyers. The fine paid into the EU budget compensates no haulier: it establishes the fault, and it is for you to pursue your civil right to reparation.

Purchase, lease or vehicle already sold: your right stands
Eligibility depends neither on the financing arrangement nor on whether the truck is still in your fleet. The rules are identical whatever the financing: see outright purchase or credit, leasing and hire purchase, long-term hire and trucks sold or scrapped.
Directive 2014/104/EU assigns the right to reparation to the economic entity that bore the overcharge at the time of the original transaction. Reselling the vehicle does not erase that past loss.
How your claim is calculated
The original overcharge is only part of your claim. The decisive lever is the compounding of statutory late payment interest, accrued over twelve to twenty-eight years.
Worked example: for an Actros bought new in 2006 at EUR 110,000 net, a 15 % overcharge of EUR 16,500 and twenty years of statutory interest at 4 % per year bring the total recoverable amount to roughly EUR 36,150 for that single vehicle.
